On June 18, 2014 I will be part of a distinguished panel of experienced litigators addressing Medical Experts and Records for the National Business Institute. This is a full day program offering 7.2 NJ CLE credits including 1.2 ethics/professionalism credits.  I will be handling the Ethics and Experts aspect of the program. You often hear of “spoliation” of records – but most often in the context of a large commercial litigation matter like the recent Apple v Samsung litigation in which both parties were subject to an “adverse inference” charge – but spoliation occurs in the everyday cases we all handle.  I’ll talk about how to avoid, it, how to recognize it, and why who does it and when it is discovered determines the remedies for it. I’ll also discuss how to maintain confidentiality and privilege in your communications with medical experts, how to protect your work-product, and when the attorney–client privilege is waived in regard to information shared with your expert. I’ll also talk about avoiding ethical trouble in how you agree to compensate your expert witness and how to avoid conflicts of interest in being the middleman between your client and their (unpaid) treating physicians or experts; an important everyday concern.
